These terms and conditions are very important and you should read them with due care and attention. Definitions The Company, us, or we, refers to Eureka Innovations Ltd. The Customer or you, means the person who buys or agrees to buy goods from the company. SpecificationsWhen the customer purchases or agrees to buy a computer from the company, we are not obliged to send you the exact specification that was detailed. However, if there is any change to or unavailability of a product then we will contact you as soon as possible before dispatch and you will be able to pull out of the transaction. Any changes we make will be an equivalent or better. Some very minor modifications to the specification may be made without prior contact, including but not limited to branding of the Hard Drive. After you agree to the changes stated, you will have the same rights as detailed in the rest of these terms and conditions. OrdersNo order from any quotation, price list, our Website or any other similar document from the company is binding unless or until it is accepted by the company itself. We can accept or reject any order for any reason whatsoever. Acceptance does not include the Google Checkout payment going through. You will get an email as soon as your order is accepted. We will try to give an explanation for the order rejection and then offer an alternative. Despatch and DeliveryCustomers will receive both an estimated dispatch and delivery date. As they are estimates, the exact date is not certain; however we strive to keep to these dates. We are not responsible for any costs, damages or expenses the customer incurs by failing to meet a delivery date. We will also provide a tracking number if possible. Due to the custom specifications and on demand purchasing of our components (ALL of our computers are considered custom), all orders must be cancelled within 12 hours of the order being accepted (you will receive an email when your order has been accepted) for a full refund. If we allowed cancellations after this time, our prices would be much higher. For some special cases, which are at our sole discretion, more time may be allowed. In all other cases a majority refund will be provided, usually approximately 10% of the total purchase price will be deducted to cover our costs but it may be more. As soon as the customer signs for the delivery, the person who accepts the delivery signs for it or it is delivered by the courier, the system is under the responsibility of the customer. The customer should check the system before signing as we will not accept claims that the system arrived damaged or missing something. If you want to collect the computer from us, please contact us. This avoids delivery charges if applicable. OwnershipFull legal ownership will not pass to the customer until the company has received the full payment for the products. The full risk of the goods passes from the company to the customer upon delivery. Warranty and ReturnsMany of our computers are covered by our own 12 month return to base warranty, but some purchased with an extended or shortened warranty will be different. Our warranty covers your computer for any hardware-related issues from the date of purchase. Our warranty is void if you overclock, replace, remove or change any components. Adding your own components will also void the warranty. We will not cover any parts that you supply to us, only components that we supply ourselves. Warranty is also void if the product is considered mistreated. We do not cover any software issues, like the misuse of software, installation of malicious software or driver defects. While under the warranty, we cover the costs for the replacement parts, labour and delivery back to you. The customer must pay in full for the delivery of the computer to get to us. It should be packaged in the original packaging or better that will be able to be used TWICE (once for sending back to us, once for us returning it to you). If incorrect or inadequate packaging is used, you will be charged for packaging materials (usually around £20 incl. VAT) and for any damage incurred during transit. Using the original packaging, if it is in a bad condition, can also be deemed inadequate. We are not responsible for any damage during transit or lost items when you are returning the product to us. This damage will be charged as extra. We will give you as many options as possible for what you can do if this situation arises. We recommend using an insured courier with proof of purchase. In any situation when you are returning a product, we may not be able to receive the same replacement and will have to offer you alternatives of equal or better specifications or value. When this happens, there will be no extra charge unless you choose a different component yourself which has a different value. If no fault is found and no component needs replacing then you will be charged for the delivery back to you and an investigation charge. The delivery can cost anything up to £50 depending on the weight and worth of your computer. The investigation charge can cost anything up to £45. If payment of any additional charges is refused by the customer, we reserve the right to not deliver the computer back and take ownership of the computer. OverclockingOverclocking any component immediately VOIDS any warranty with us. There are no exclusions. We are not responsible for any damage to components or performance due to overclocking. If you buy a computer which has been overclocked by us, the warranty will stand for the specifications we overclocked it to and overclocking any further will result in your warranty being void. Damage LiabilityUnder no circumstances shall the company be responsible for any incidental, indirect or consequential damages. We are also not responsible for injuries resulting from using, handling or owning the computer, including but not limited to repetitive strain injury. Product MisuseDamage due to extreme operating conditions or abnormal humidity, including but not limited to, temperature, electromagnetic interference, vibration, power surges/transients/dropouts will be charged to you, the customer, as they are not covered under warranty. Accidental damage, abuse, misuse and negligence will all void our warranty.
